Dardik Case Update: Court Hearing Ends Without Ruling as Hunger Strike Reaches Day 33
Yesterday a hearing took place at the Jerusalem District Court concerning the case of Tal Yinon Dardik. Judge Avraham Rubin did not issue an immediate ruling and indicated a written decision would follow. As of Friday afternoon, none has been released. Dardik remains detained at the Russian Compound and is on the 33rd day of a hunger strike.
The hearing addressed an appeal by Central Command Maj. Gen. Avi Bluth, filed through the Jerusalem District Attorney’s Office, against a Military Court of Appeals ruling that the order targeting Dardik is unenforceable. The appeal contradicted Defense Minister Israel Katz’s directive to drop the matter.
At issue is whether authorities may impose administrative house arrest on a settler in a residence that is not his own and without the owners’ consent, even absent indictment or proven guilt. Bluth, through the Jerusalem District Attorney’s Office, claims that he has the authority to order administrative house arrest for settlers—without indictment and without guilt—even not in their own home, but in someone else’s home, and even against the homeowners’ consent. Honenu attorney Moshe Polsky urged the court to reject the appeal, affirm the order’s illegality, and order Dardik’s immediate release. Supporters continue to await the decision, hoping the appeal is denied and the case ends.
